We are LowCountry Capital Mortgage LLC, doing business as LowCountry Capital ("Company," "we,"
"us," or "our"), a company operating in South Carolina, United States. Our home office is located at 308

We operate the website https://www.lowcountry-capital.com (the "Site"), as well as any related landing
pages, forms, scheduling pages, advertisements, communications, and services that refer or link to these
Terms of Service (collectively, the "Services").

purposes relating to mortgage brokerage and financing solutions. The Services are not intended for
distribution to or use by any person or entity in any jurisdiction where such use would be contrary to law or
regulation.
The Services are not intended to comply with industry-specific requirements unrelated to mortgage
brokerage, such as HIPAA or FISMA. You may not use the Services in any way that would violate
applicable privacy, consumer protection, advertising, lending, or communications laws.
2. MORTGAGE BROKERAGE DISCLAIMER
LowCountry Capital is a mortgage brokerage business. Information provided through the Services does not
constitute a commitment to lend, lock, approve, or extend credit. Any loan terms, rates, fees, approvals, or
program availability are subject to change without notice and remain subject to full underwriting review,
investor approval, appraisal, title review, verification of borrower information, and satisfaction of all
applicable lending conditions.
Nothing on the Site or in our communications should be interpreted as financial, tax, legal, or investment
advice. You should consult your own professional advisors before making financing or investment
decisions.
NMLS ID 2158547 is provided for identification purposes. Licensing, product availability, and program
eligibility may vary by state and borrower profile.
3. INTELLECTUAL PROPERTY RIGHTS
We are the owner or licensee of all intellectual property rights in the Services, including all source code,
databases, functionality, website designs, text, graphics, photographs, logos, and related materials
(collectively, the "Content"), as well as the trademarks, service marks, and logos contained therein (the
"Marks").
The Content and Marks are provided through the Services on an "AS IS" basis for your personal, non-
commercial use or internal business purpose only. Except as expressly permitted in these Terms of
Service, no portion of the Services may be copied, reproduced, republished, uploaded, posted, publicly
displayed, distributed, sold, licensed, or otherwise exploited without our prior written consent.

4. USER REPRESENTATIONS
By using the Services, you represent and warrant that: (a) you have the legal capacity to agree to these
Terms of Service; (b) you are not a minor in the jurisdiction in which you reside; (c) you will not access the
Services through automated or non-human means except through ordinary browser functionality; (d) you
will not use the Services for any unlawful or unauthorized purpose; and (e) your use of the Services will not
violate any applicable law or regulation.
If you provide information that is false, inaccurate, outdated, or incomplete, we reserve the right to suspend
or terminate access to the Services.
5. PROHIBITED ACTIVITIES
You may not access or use the Services for any purpose other than that for which we make them
available. Prohibited conduct includes, without limitation: attempting to interfere with site security; scraping
or harvesting data; uploading malicious code; impersonating another person; using the Services to transmit
spam or unlawful solicitations; infringing intellectual property rights; or using the Services in a way that
violates lending, marketing, TCPA, privacy, or consumer protection laws.
We reserve the right to restrict or terminate access for any user who engages in prohibited conduct.
6. PRIVACY POLICY
We care about data privacy and security. By using the Services, you agree to be bound by our Privacy
Policy and Cookie Policy, each of which is incorporated into these Terms of Service by reference. Our
Services are hosted in the United States, and by using them you consent to the transfer, storage, and
processing of your information in the United States, subject to applicable law.
7. TERM AND TERMINATION
These Terms of Service remain in effect while you use the Services. We reserve the right, in our sole
discretion and without notice or liability, to deny access to and use of the Services for any reason, including
without limitation for breach of these Terms of Service or applicable law.
8. MODIFICATIONS AND INTERRUPTIONS
We reserve the right to change, modify, suspend, or discontinue the Services at any time without notice.
We do not guarantee that the Services will be available at all times and are not liable for downtime, delays,
interruptions, or errors.
9. GOVERNING LAW
These Terms of Service and your use of the Services are governed by and construed in accordance with
the laws of the State of South Carolina, without regard to conflict of law principles.
10. DISPUTE RESOLUTION
To expedite resolution and control the cost of disputes, the parties agree to first attempt to resolve any
dispute informally for at least thirty (30) days before initiating formal proceedings.
If a dispute cannot be resolved informally, it shall be resolved exclusively through binding arbitration in
Charleston County, South Carolina, except where prohibited by law or where injunctive relief is sought to
protect intellectual property or confidential information. If arbitration is unavailable or unenforceable, the
parties consent to exclusive jurisdiction and venue in the state or federal courts located in Charleston
County, South Carolina.
11. CORRECTIONS
There may be information on the Services that contains typographical errors, inaccuracies, or omissions,
including descriptions, pricing, program terms, or availability. We reserve the right to correct any such
errors, inaccuracies, or omissions and to change or update information at any time without prior notice.
12. DISCLAIMER
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST
EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED,
INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE,
AND NON-INFRINGEMENT.
WE MAKE NO WARRANTY THAT THE SERVICES WILL BE ERROR-FREE, SECURE, OR
UNINTERRUPTED, OR THAT ANY CONTENT, PROGRAM INFORMATION, OR COMMUNICATION
WILL BE CURRENT, COMPLETE, OR AVAILABLE AT ANY PARTICULAR TIME.
13. LIMITATIONS OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE, OUR MEMBERS,
OFFICERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT,
INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF
OR RELATING TO YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE
SERVICES SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR
THE AMOUNT PAID BY YOU TO US, IF ANY, IN THE THREE (3) MONTHS PRECEDING THE EVENT
GIVING RISE TO THE CLAIM.
14. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless LowCountry Capital Mortgage LLC DBA LowCountry
Capital and its affiliates, officers, employees, and agents from and against any loss, liability, claim,
demand, or expense, including reasonable attorneys’ fees, arising out of your use of the Services, your
breach of these Terms of Service, or your violation of any law or the rights of a third party.
15. USER DATA
We maintain certain data that you transmit to the Services for performance, security, communication, and
recordkeeping purposes. Although we use reasonable safeguards, you acknowledge that no method of
transmission or storage is completely secure and that you provide data at your own risk.
16. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES
Visiting the Services, sending emails, submitting forms, and otherwise communicating with us
electronically constitute electronic communications. You consent to receive electronic communications and
agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy
any legal requirement that such communications be in writing.
17. SMS TEXT MESSAGING AND MARKETING COMMUNICATIONS
By providing your phone number through our website, landing pages, forms, advertisements, scheduling
pages, or other lead capture methods, you expressly consent to receive calls, SMS text messages, emails,
and other electronic communications from LowCountry Capital regarding mortgage-related inquiries, loan
updates, appointment confirmations, customer support, and, where permitted by law and with appropriate
consent, marketing communications. Message frequency varies. Message and data rates may apply. Consent to receive SMS or marketing
communications is not a condition of obtaining any loan, product, or service from us.
You may opt out of SMS messages at any time by replying STOP. For assistance, reply HELP or contact

We maintain records of communication opt-ins and opt-outs. Mobile information and SMS consent data are
not shared with third parties or affiliates for their own marketing or promotional purposes.
18. SMS CARRIER LIABILITY DISCLAIMER
LowCountry Capital Mortgage LLC is not responsible for any delays or failures in the receipt of any SMS messages. Delivery of messages is subject to effective transmission from your wireless service provider and is not guaranteed.
Carriers are not liable for delayed or undelivered messages.
Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary based on your interaction with our services.
If you have any questions about your text plan or data plan, please contact your wireless provider.

20. MISCELLANEOUS
These Terms of Service and any policies or operating rules posted by us on the Services constitute the
entire agreement between you and us regarding the Services. Our failure to exercise or enforce any right
or provision shall not operate as a waiver. If any provision is determined to be unlawful, void, or
unenforceable, that provision shall be severable and shall not affect the validity and enforceability of any
remaining provisions.
